Intro & Grant Of License
This document constitutes a legal agreement outlining the rights and responsibilities of the individual or entity ("you" or "Licensee") downloading an Enrico Sogari trial font software product ("Trial Product") and Enrico Sogari / Sogari Design ("Enrico Sogari", "we" or "us"). By downloading, installing, or using any Trial Product, you acknowledge that you are entering into a contractual relationship with us under the terms of this Agreement. If the licensee is an entity, you confirm that [1] you have the authority to bind the entity to this Agreement and to license Trial Products on its behalf, [2] the entity will be bound by this Agreement as you are, [3] this Agreement will be enforceable against both you and the entity, and [4] you will ensure that every person employed by the entity who accesses the Fonts or Software (each an "Authorized User") receives a copy of this Agreement and complies with its terms. We grant you a license to use the specific fonts ("Fonts") and software ("Software") included in the Trial Products under the terms of this Agreement. The license: [1] is non-exclusive; [2] permits use solely by you and may not be shared or transferred to any other person or entity; [3] allows use strictly for trial purposes. It explicitly prohibits making the Software or Fonts available in downloadable or editable forms, or using them for rendering or displaying web content in any manner. Definitions
In this license Agreement: [1] “you” denotes the individual entering into this license Agreement and, where applicable, the entity (such as a Licensee) on whose behalf this license Agreement is or has been entered into; [2] “entity” refers to a legally recognized corporate entity; [3] “font” encompasses typeface, bitmap, and any technology resulting in its representation; [4] “use” pertains to the accessibility, inclusion, or replication of any Fonts or the typefaces they represent in any part of a work, across any medium; [5] “trial purposes” means the use of the Trial Product (a) to represent part of the Font set in presentation materials viewed solely by the Licensee and their actual or potential clients, (b) exclusively for the Licensee and their actual or potential clients to assess whether to commercially license the Software and Fonts, and (c) for no other purpose.

Usage Limitation
The Software or any Font may be used concurrently on a maximum of three devices at any given time.
Trial Usage Restrictions
This Agreement permits the use of the Trial Product solely for trial purposes. Accordingly, you agree not to use any Software or Fonts for commercial activities, including but not limited to: [1] in print or digital publications; [2] in advertising, marketing, or promotions; [3] in the creation of logos or brand identities; [4] on product packaging, among other uses not explicitly permitted under this Agreement. Exclusively for trial purposes the licensee can use the Font Software to generate non-editable .pdf documents.
Additional Usage Restrictions
In addition to other provisions outlined in this Agreement, the following uses of the Fonts are explicitly prohibited: [1] caching, storing or serving a Font via the internet to users through a server, intranet, or any other technology; [2] internal corporate or widespread business use or distribution; [3] modifying or creating derivative versions of a Font; [4] converting a Font from one file format to a different one; [5] converting a Font for use in operating systems other than its original provision; [6] using the Fonts in creating alphabet or letterform products for resale or in letterform creation products; [7] using the Fonts in titling, credits, text, for broadcast or distribution such as via Film, TV, Steaming or the Internet; [8] using the Fonts on behalf of a third party; [9] transferring Font use from one licensee to another; [10] using the Fonts as a Web font; [11] transmitting and embedding the Fonts and Software; [12] use the Fonts to train or enhance any artificial intelligence (AI) models, including machine learning algorithms, neural networks, or other AI applications.
Restrictions On Copying And Modifying
The Licensee is strictly prohibited from copying or distributing any Trial Products except as expressly permitted in this license Agreement. The Licensee must ensure that no Font is distributed in any manner that allows the Font to be altered or adapted by any person. The Licensee is also prohibited from reverse engineering, extracting, decompiling, or attempting to uncover the source code of the Trial Products, unless explicitly allowed by applicable law. All copies of Trial Products must be maintained under your exclusive control.
Intellectual Property Ownership
You acknowledge and agree that we exclusively own all rights, titles, and interests in and to the Software, Fonts, Enrico Sogari Products, and the typefaces they depict, including any copyrights associated with them. The Enrico Sogari Products are protected by copyright under German legislation and international copyright treaties. Font names are also our trademarks. We reserve all rights not explicitly granted in this license Agreement.
Your Details
You are required to ensure that we consistently have accurate and current information regarding your correct email address and any other details provided to us during the purchasing process.
Data Protection
We commit to handling the personal data you provide in compliance with our Privacy Policy.
Font Warranty
It is your responsibility to ensure that the application you intend to use with our Trial Products supports the font format in which the Font is supplied. We provide no warranty regarding the performance or results that may be achieved through the use of Trial Products.
Disclaimer Of Liability And Excluded Losses
Enrico Sogari is not liable for any failure to fulfill its obligations under this license Agreement due to circumstances beyond its reasonable control. Your use of Trial Products carries inherent risks, and we disclaim all liability to you or any third party for any indirect or consequential losses or damages, such as loss of data, profits, revenue, or business, regardless of the cause, whether due to negligence, breach of this license Agreement, or any other reason. We do not guarantee or warrant Trial Products, excluding all implied conditions, terms, representations (except for fraudulent or negligent representations), and warranties, whether imposed by statute, operation of law, or otherwise, unless expressly stated in this license Agreement. This exclusion covers implied warranties of satisfactory quality for a particular purpose, except where such exclusions are prohibited by law. Your statutory consumer rights remain unaffected.
Non-Excluded Liabilities
This license Agreement and any license do not limit Enrico Sogari’s liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
Audit Requirements
In the event that Enrico Sogari finds sufficient grounds to suspect infringement of this license Agreement or a license, you acknowledge and agree that we reserve the right, with reasonable notice to the Licensee, to access any premises where Trial Products are used in order to determine your compliance with this Agreement and our rights.
Termination Of License
We reserve the right to terminate the license of a Trial Product granted to you at any time, with immediate effect, by sending notice to the email address you provided when you downloaded the Trial Product. Upon termination of this Agreement, you must destroy the original and all copies (including all copies stored in the memory of any hardware device) of the Trial Products and, if requested by us, provide evidence demonstrating compliance with this requirement.
Assignment
You are prohibited from renting, leasing, sub-licensing, giving, lending, or further distributing the Font Software, or any part or copy of it, except if expressly permitted in this license Agreement. Enrico Sogari reserves the right to assign this license Agreement and each license, including the assignment of all associated rights and obligations.
Entire Agreement
This license Agreement and each license constitute the complete agreement between the Licensee and Enrico Sogari regarding Trial Products and all matters covered herein. It supersedes all prior agreements and understandings concerning these products, except in cases of fraud or fraudulent representation by either party.
Salvatorius
If any term of this license agreement or any license is deemed invalid or unenforceable by a judicial decision or decree, the remaining provisions of this license agreement and such license shall continue to be valid and enforceable.
Law
This license Agreement shall be governed by the laws of Germany and any disputes or legal proceedings will be handled entirely in Berlin.
